Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User") and Nest-Scout Advisory, a luxury real estate advisory practice operated by Parvesh Gilhotra, having its principal place of business at Sector 42, Gurugram, Haryana – 122002, India (also known as "Nest Scout", styled "Nest-Scout", "we", "us", or "our").

By accessing or using the Nest-Scout website, mobile platform, or any associated digital services (collectively, the "Platform"), you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must immediately discontinue use.

You must be at least 18 years of age and legally competent to enter into contracts under the Indian Contract Act, 1872 to use this Platform.

Nest-Scout provides a curated digital marketplace and advisory service for luxury residential real estate in the Delhi NCR region. Our services include:

• Displaying verified property listings and market intelligence
• Facilitating introductions between prospective buyers and property developers/sellers
• Providing personalised investment advisory through qualified consultants
• Offering tools including mortgage calculators and property comparisons

Important: Nest-Scout acts as an advisory intermediary and does not hold title to, or sell, any property listed on the Platform. All transactions are conducted directly between the buyer and the developer/seller. We are not a party to any purchase agreement, booking form, or sale deed.

Certain features of the Platform (including viewing exclusive listings and property comparisons) require registration via OTP-based phone verification. By registering, you agree to:

• Provide accurate, current, and complete information
• Maintain the confidentiality of your account session
• Notify us immediately of any unauthorised access at info@nest-scout.com
• Accept responsibility for all activity conducted through your account

We reserve the right to suspend or terminate accounts that violate these Terms, misuse the Platform, or provide false information.

We strive to present accurate and up-to-date property information. However:

• Pricing, availability, and specifications are subject to change without notice and must be independently verified with the developer or seller before any financial commitment.
• Images, renderings, and floor plans are representational and may differ from actual properties.
• "Price on Request" listings indicate exclusive inventory where pricing is disclosed only to verified members.
• RERA registration numbers, possession timelines, and approvals must be confirmed directly with the relevant authority or developer.

Nest-Scout does not guarantee the accuracy, completeness, or timeliness of any listing data.

You agree not to:

• Use the Platform for any unlawful purpose or in violation of applicable Indian law
• Scrape, crawl, or systematically extract data from the Platform without prior written consent
• Post, transmit, or distribute false, misleading, defamatory, or fraudulent content
• Impersonate any person, entity, or Nest-Scout representative
• Attempt to gain unauthorised access to any part of the Platform, our servers, or associated databases
• Engage in any activity that disrupts, damages, or interferes with the Platform's normal operation
• Use the Platform to solicit business on behalf of competing real estate services

All content on the Platform — including text, graphics, logos, photographs, property listings, market reports, and software — is the exclusive property of Nest-Scout Advisory or its content licensors and is protected under the Copyright Act, 1957 and other applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform solely for personal, non-commercial purposes. You may not reproduce, distribute, modify, create derivative works from, or publicly display any Platform content without our prior written consent.

Information provided on the Platform is for general informational purposes only and does not constitute professional legal, financial, tax, or investment advice. Real estate investments carry inherent risks including loss of capital. You should seek independent legal and financial advice before making any property investment decision.

Past performance of real estate markets referenced on the Platform is not indicative of future results. Nest-Scout does not guarantee investment returns, rental yields, or capital appreciation.

The Platform may integrate or link to third-party services (including WhatsApp, mapping services, and developer portals). Nest-Scout is not responsible for the content, privacy practices, or terms of these third-party services. Your interactions with them are governed by their respective terms.

To the maximum extent permitted by applicable law, Nest-Scout, its principals, employees, and agents shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, goodwill, or business opportunities
• Reliance on information provided on the Platform that results in financial loss
• Service interruptions, data breaches by third-party actors, or technical failures beyond our reasonable control

Our total aggregate liability for any claim arising out of or related to these Terms or the Platform shall not exceed the amount you paid us (if any) in the 12 months preceding the claim.

You agree to indemnify, defend, and hold harmless Nest-Scout and its principals, employees, agents, and service providers from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use or misuse of the Platform; (b) your violation of these Terms; or (c) your violation of any applicable law or third-party rights.

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts at Gurugram, Haryana.

Before initiating formal proceedings, both parties agree to attempt resolution through good faith negotiation for a period of 30 days from the date of written notice of the dispute.

We reserve the right to modify these Terms at any time. Material changes will be communicated via a prominent notice on the Platform or by email. Your continued use of the Platform after such changes become effective constitutes your acceptance of the revised Terms.

We reserve the right to suspend or terminate your access to the Platform at our sole discretion, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, third parties, or the business. Upon termination, all licences granted hereunder shall immediately cease.

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
